Thank you for accessing hasa.com. This website (“Site”) is owned and operated by HASA, Inc., a California corporation (“HASA,” “we,” “us,” or “our”). This privacy policy (“Policy”) describes the personal information we collect about you on the Site, through our mobile application (the “App”) and when you communicate or interact with HASA. This Policy covers our online experience in the United States and is intended to provide you with notice of our data practices, including the categories of personal information we collect, the purpose for which we use it, and your rights regarding your personal information. By accessing the Site, you agree to this Policy, as it may be amended from time to time.

Types Of Information We Collect and How We Collect It

We collect information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked directly or indirectly, with you or your household (“personal information”). The following describes the categories of personal information we have collected within the preceding twelve (12) months, the sources from which collected the information, and the business or commercial purposes for which we use it.

  • Identifiers: Name, email address, physical address, phone number, account name, IP address, and device identifiers.
    • Sources: Directly from you; automatically through the Site or App; from third-party marketing partners.
    • Purpose: To provide products and services; fulfill orders; communicate with you; personalize your experience; marketing and advertising; fraud prevention; legal compliance.
  • Customer Records: Name, address, telephone number, credit or debit card number, and financial information related to transactions.
    • Sources: Directly from you when making purchases or creating an account.
    • Purposes: Processing transactions and payments; fulfilling orders; managing refunds and exchanges.
  • Protected Classification Characteristics: Gender and birthday (when voluntarily provided).
    • Sources: Directly from you.
    • Purposes: To personalize your shopping experience and provide relevant offers.
  • Commercial Information: Purchase history, products or services purchased, purchasing tendencies, and records of products or services considered.
    • Sources: From your transactions on the Site or App; from your browsing activity.
    • Purposes: Order fulfillment; understanding shopping preferences; improving products and services; personalized marketing.
  • Internet or Network Activity: Browsing history on our Site, search history, information regarding your interaction with our Site or advertisements, and device information.
    • Sources: Automatically through cookies and similar technologies on the Site and App.
    • Purposes: Website analytics; personalization; targeted advertising; fraud prevention.
  • Geolocation Data: Approximate location derived from IP address; precise location from GPS, cell tower, or Wi-Fi signals (when you enable location services).
    • Sources: Automatically from your device.
    • Purposes: To provide location-based services and content; personalized offers relevant to your location; fraud prevention.
  • Inferences: Profiles reflecting preferences, characteristics, behavior, and attitudes.
    • Sources: Derived from other personal information we collect.
    • Purposes: To create a profile about you to personalize your experience and deliver relevant advertising.
  • Sensitive Personal Information: Precise geolocation (when location services are enabled); credit or debit card number in combination with security code or password.
    • Sources: Directly from you; automatically from your device.
    • Purposes: Processing payments; providing location-based services. We do not use sensitive personal information for purposes other than those permitted under California law. You have the right to limit our use of your sensitive personal information as described in the “Your Privacy Rights” section below.

We may combine information you give us online or through our mailers to better serve you. We may also combine that information with publicly available information and information we receive from or cross-reference with select partners and others. By combining this information, we are better able to communicate with you about our products, services, events and promotions and to personalize your shopping experience.

Data Retention

We retain your personal information for as long as necessary to fulfill the purposes for which it was collected, including to satisfy legal, accounting, or reporting requirements. The retention period for specific categories of personal information is determined based on the following criteria:

Account and Transaction Data: We retain your account information and transaction history for a reasonable period thereafter as necessary to comply with applicable legal, tax, accounting, and regulatory record-keeping requirements.

Marketing and Communications Data: We retain records of your marketing preferences and communications for as long as you maintain an account with us or until you opt out, plus a reasonable period thereafter to honor your preferences.

AI Chatbot Conversations: Conversation messages with our AI Bot are retained until deleted by us or upon your request. Usage analytics derived from chatbot interactions are retained in aggregate form for a reasonable period to analyze trends and improve our services.

Audit Logs: System audit logs are retained for as long as necessary for compliance, security, and regulatory purposes.

Cookie Consent Records: Our cookie consent management provider, Cookiebot (Cybot), retains a log of your Consent ID and consent state for potential auditing purposes, enabling us to provide proof of consent upon request. The first-party consent cookie stored on your device persists for a limited period in accordance with industry standards.

How We Share Your Information

We may share your information in certain circumstances, including:

Vendors and other Third Parties:

We may authorize our franchisees, vendors and other third-party companies to provide certain services. We provide these companies with information they may need to perform their services. These third parties are contractually obligated to use your information only for the purposes for which it was disclosed and in accordance with this Policy. The services provided include:

Information Technology:

    • Hosting and operating the Site, our App and other platforms
    • “Powered by” partners for payments and other services
    • Processing transactions and payments
    • Digital marketing and advertising
    • AI and chatbot services (including Pisteyo/Crystal and related sub-processors such as OpenAI, Qdrant, and Microsoft Azure)
    • Cookie consent management services (Cookiebot CMP, provided by Cybot), including serving cookie consent banners, blocking non-essential cookies prior to consent, logging visitor consent decisions, and monitoring for opt-out preference signals such as Global Privacy Control (GPC)
    • Marketing analytics and attribution services (including WebFX), including tracking of website activity (page views, form submissions, traffic sources) and phone call tracking (call occurrence, duration, source, and publicly available caller ID information). Phone call tracking does not include call recording unless separately disclosed and consented to.

 

Legal or Business Requirements, Including:

    • Disclosure to comply with the law
    • Disclosure to enforce or apply our terms and conditions and other agreements
    • Facilitating financing, securitization, insuring, sale, assignment, bankruptcy, or disposal of all or part of our business or assets
    • Protecting the rights, property, or safety of our company, our customers, or others
    • In connection with a sale or merger

Social Sharing, Including:

    • Using your social media account to share products or other content from our website to your social media accounts. By making this connection you authorize us to share information with your social media account provider, and you understand that the use of the information we share will be governed by the social media site’s privacy policy.

Shared by You, Including:

    • Posting to the Site or public forums, such as HASA social media pages, blogs, and online reviews
    • Information you disclose through these services will become public
    • Information you disclose to us as part of your participation in our SMS/MMS Mobile Message Marketing Program.

At Your Discretion, Including:

    • At your request
    • As described at the point of collection
    • With your consent

Where third parties qualify as “service providers” or “contractors” under California law, we maintain written contracts that prohibit them from selling or sharing your personal information, retaining or using it for purposes other than performing services, or combining it with other data except as permitted by law. Our current service providers with CCPA-compliant agreements include WebFX (marketing analytics) and Pisteyo (AI chatbot services), and Cybot (Cookiebot cookie consent management).

Automated Information Collection

We may collect information about you using automated information collection technologies. Such information may include browser and device information, demographic information and other information provided by you, and aggregated information where we combine your information with information obtained from other users and other sources. We may use and disclose such information for any lawful purpose.

Use of Artificial Intelligence

HASA leverages the power of artificial intelligence (“AI”) in the form of a chatbot called “Crystal” (the “AI Bot”) on the Site and the App. The AI Bot has the ability to provide answers to questions about pool maintenance, construction, water sanitization methods, and pool size. In the future, the AI Bot may be enabled to include the ability to provide assistance in the purchasing of products and provide you with your account information, such as retrieving any orders you place through the Site or the App. The AI Bot’s collection and use of personal data in developing and deploying its features are consistent with commitments outlined in this Policy, including your request for data removal, with the following exceptions:

a. The AI Bot only temporarily collects the following personal information: Your role or relationship to us, zip code, and email address. These fields are requested together in a single message and only once per conversation. The AI Bot will not proactively solicit any other personal information. After your session with the AI Bot is complete or timed out, the AI Bot will transfer your information to our customer relationship management system.

b. To provide continuity across your interactions with the AI Bot, a Conversation ID may be stored and used to maintain context between sessions. This enables the AI Bot to recall prior interactions within a conversation thread. You may request deletion of your conversation history at any time by contacting us using the information provided below.

c. Chat messages transmitted to OpenAI through the AI Bot may be retained by OpenAI for a limited period for safety and abuse monitoring purposes, after which they are deleted. Neither OpenAI nor any other sub-processor uses your data to train, fine-tune, or improve their AI models. Our service provider agreements require sub-processors to be bound by equivalent contractual restrictions.

d. The purpose of the AI Bot’s collection of information is to enable the AI Bot to transfer your information to our customer relationship management system in the event that your question requires one of our human representative’s assistance and response.

e. AI-generated responses are provided for general informational purposes only and may contain inaccuracies, errors, or incomplete information. The AI Bot does not provide legal, medical, financial, or regulatory advice, and its responses should not be relied upon as a substitute for professional guidance. HASA makes no representations or warranties regarding the accuracy, completeness, or reliability of any AI-generated content, and you acknowledge that any actions you take based on AI Bot responses are at your own risk and sole discretion. HASA shall not be liable for any damages, losses, or consequences arising from your use of or reliance on AI-generated responses. If your inquiry requires assistance beyond the AI Bot’s capabilities, you will be directed to contact a human representative.

We will not use the information you provide to develop or train our AI Bot.

Cookies and Related Technology

When you first visit our Site, you may be presented with a cookie consent banner that allows you to accept or decline non-essential cookies. Our third-party marketing and analytics tools, including our marketing tracking pixel, are designed to integrate with cookie banner blocking based on your choices. If you decline cookies through this banner, non-essential tracking technologies will be blocked. Cookies on our Site are organized into four categories: (1) Necessary (strictly required for the Site to function), (2) Preference (enabling personalized features), (3) Statistics (helping us understand how visitors use the Site), and (4) Marketing (used for advertising and tracking). Before you provide consent, Cookiebot receives and processes your IP address, browser language, user agent, and the website URL solely to serve the correct consent banner for your geographic location and legal jurisdiction; none of this data is retained by Cookiebot after the banner is served. After you make a consent choice, Cookiebot generates a unique Consent ID and logs it along with your consent state for auditing purposes. The Consent ID and your preferences are stored on your device in a first-party cookie that is not accessible to other websites or third parties and is not used for tracking. If you decline non-essential cookies, our marketing and analytics tools, including our tracking pixel, are automatically blocked.

We and our service providers use cookies, pixels, web beacons and similar technologies to collect information when you interact with our Site, App, or third-party platforms displaying our content. This information, may include, but is not limited to, the pages you visit on our site, ads you interact with, referring URLs, browser and device type, activity, search terms, and IP address-based geographic location. We use this data to personalize your experience, improve our services, and deliver relevant marketing. This includes HASA content presented on another website or mobile application. These technologies also enable us to provide features such as storage of items in your cart between visits.

The help function of your browser should contain instructions on how to set your computer to accept all cookies, to notify you when a cookie is issued or to not receive cookies at any time. If you set your device to not receive cookies at any time, certain personalized services may not be provided to you, and accordingly, you may not be able to take full advantage of all of our features (i.e. you will be able to browse the site, but you may not be able to make a purchase). You can block or control Adobe Flash based collection using the Website Storage Settings Panel and the Global Storage Settings Panel and following the instructions provided (the instructions for blocking or controlling Adobe Flash are provided here for convenience only and they may change).

Location Information

When you use our website and other services, we may use automated technology to collect information indicating the physical location of your device, such as GPS data, cell phone tower data, Wi-Fi signals, or your device’s IP address. We may use and disclose your location information as described in this Policy. For example, we may use your device’s physical location to provide you with personalized location-based services and content, such as sending you information pertaining to products or offers that are relevant to your location. You may be permitted to allow or deny such uses, but if you do deny them, we may not be able to provide you with a personalized user experience.

Analytics

We use analytics services, such as Google to understand how visitors interact with our Site. These services use cookies, pixels, and similar tracking technologies to collect and analyze usage data, including pages visited, session duration, and traffic sources.

 

 

Mobile

If you use a mobile device, your device may share location information (when you enable location services) with our website, services, or our service providers. We may also track and collect usage data, such as the date and time you use a mobile application to access our servers and the specific information accessed, based on your device number or other identifier. We use this information to improve our services, and provide you with more relevant and personalized advertisements, services, and promotions. We may also receive data and information provided by you if you participate in our SMS/MMS Mobile Message Marketing Program.

Aggregated Information

We may collect and use aggregated personal information, which does not personally identify you. For example, we may calculate the percentage of our site users who have a particular zip code. In the course of aggregating data, we may combine third party data with yours and that of other users.

Cross-Device Identification

If you use multiple devices to access the Site, we may acquire and utilize capabilities that link your various devices so that content you access on one device can result in relevant advertising on another device. Information we have collected from your different devices may be combined with other information you have provided us. We may use such information to help provide more tailored experiences and consistent services and experiences across all of your devices as explained in this Policy. We also may use this information to prevent fraud, such as by identifying when your account is accessed from an unfamiliar device.

Behavioral/Targeted Advertising

We and our advertising partners use cookies, pixels, and similar technologies to deliver advertisements tailored to your interests. These partners may collect information over time about your activity on our Site and other sites and your interaction with our advertising and other communications and use this information to determine which ads you see on third-party websites and applications. These technologies and the information collected about you may also be used to track your activity across multiple devices.

Advertising and Analytics Partners (Meta Pixel)

We use the Meta (Facebook) pixel and related tracking technologies provided through our marketing partner, WebFX, to measure advertising effectiveness and optimize our campaigns. When you visit our website, these technologies may collect and transmit to Meta: Your IP address and device/browser information; Pages you visit and actions you take on our Site (such as form submissions or purchases);Hashed identifiers (such as email address) for matching to Meta user profiles; Click identifiers and timestamps.

Meta uses this information to provide us with advertising measurement and to deliver targeted advertisements to you across its platforms, including Facebook and Instagram. This constitutes “sharing” of personal information for cross-context behavioral advertising under California law.

Your Opt-Out Rights. You may opt out of this sharing by clicking the “Do Not Sell or Share My Personal Information” link in our website footer, enabling Global Privacy Control (GPC) in your browser, or adjusting your cookie preferences. When you opt out, we configure our tracking technologies to transmit a Limited Data Use signal to Meta, restricting how your data may be processed.

Cross-Context Behavioral Advertising. We may share personal information with third-party advertising partners for cross-context behavioral advertising, which may constitute “sharing” under California law. The categories of personal information that may be shared for this purpose include: Identifiers (such as device identifiers and IP address), Internet or Network Activity (such as browsing history and interactions with advertisements), and Inferences (such as preferences and interests). You may opt out of this sharing as described in the “Your Rights (California Residents)” section below.

Please note that even if you opt-out, these tracking technologies may still collect data and you will still see ads, but they will not be targeted based upon the information collected through these tracking technologies.

Promotional Communications

You may opt out of receiving promotional communications from us at any time by clicking an Unsubscribe link in a promotional email or by sending a request to unsubscribe to our offices via email at privacy@hasa.com. If you are a user of our App and have opted out of promotional communications, HASA may continue to send you non-marketing or non-promotional emails, such as those about your account or our ongoing business relations. If you wish to opt of the SMS/MMS Mobile Message Marketing Program, please follow the instructions listed on the SMS/MMS Mobile Message Marketing Program Terms and Conditions, available on our site.

Your Rights (California Residents)

If you are a California resident you have specific rights regarding your personal information under the California Consumer Privacy Act (collectively “CCPA/CPRA”). This section describes your rights and explains how to exercise them. .

Right to Know. You have the right to request that we disclose the following information about our collection and use of your personal information over the past twelve (12) months: (1) the categories of personal information we collected; (2) the categories of sources from which we collected personal information; (3) the business or commercial purpose for collecting, selling, or sharing personal information; (4) the categories of third parties to whom we disclosed personal information; and (5) the specific pieces of personal information we collected about you. You may make a request to know up to two (2) times in a twelve (12) month period.

Right to Delete. You have the right to request that we delete the personal information we collected from you, subject to certain exceptions. You may submit a deletion request through our online privacy request form at https://na1.hs-data-privacy.com/request/AZTqttGYbOPEXS4V66OzFw, through our CRM, Orenda, at https://na1.hs-data-privacy.com/request/H7UzCjAz6ARmQcfuy3i2yw, or by using the contact methods below. Once we receive and verify your request, we will delete your personal information from our records, unless an exception applies. We may deny your deletion request if retaining the information is necessary for us to: (a) complete a transaction or provide goods/services you requested; (b) detect security incidents or protect against illegal activity; (c) debug to identify and repair errors; (d) exercise free speech or another legal right; (e) comply with applicable law; (f) engage in research in the public interest; (g) enable solely internal uses reasonably aligned with your expectations; or (h) make other internal uses compatible with the context in which you provided it.

Right to Correct. You have the right to request that we correct inaccurate personal information that we maintain about you. We will use commercially reasonable efforts to correct inaccurate personal information upon receipt of a verifiable consumer request.

Right to Opt-Out of Sale or Sharing. You have the right to direct us not to “sell” or “share” your personal information to or with third parties. HASA does not sell personal information in exchange for monetary consideration. However, certain disclosures of personal information for targeted advertising purposes may constitute “sharing” under the CCPA/CPRA. You may opt out of such sharing by: (1) clicking the “Do Not Sell or Share My Personal Information” link on our website; (2) enabling a browser-based opt-out preference signal such as Global Privacy Control (“GPC”); or (3) contacting us using the information provided below.

Right to Limit Use of Sensitive Personal Information. You have the right to limit our use and disclosure of your sensitive personal information to uses that are necessary to perform services or provide goods you request, or other uses permitted by law. HASA does not use sensitive personal information for purposes beyond those permitted under California law, so this limitation is already in effect.

Right to Data Portability. When you exercise your right to know, you have the right to receive your personal information in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the information to another entity. Right to Non-Discrimination. We will not discriminate against you for exercising any of your CCPA/CPRA rights. We will not deny you goods or services, charge you different prices, or provide you a different level or quality of goods or services because you exercised your privacy rights.

How to Exercise Your Rights. To exercise your rights described above, please submit a verifiable consumer request to us by one of the following methods:

Verification. We must verify your identity before fulfilling your request. To verify your identity, we may ask you to provide information such as your name, email address, and transaction history, which we will match against information we already maintain. For requests to know specific pieces of personal information or requests to delete, we apply a higher standard of verification.

Authorized Agents. You may designate an authorized agent to make a request on your behalf. To do so, you must either: (a) provide the authorized agent with your signed, written permission and verify your identity directly with us; or (b) the authorized agent must provide proof of a power of attorney. We may deny a request from an agent who does not submit proof of authorization.

Response Timing. We will respond to verifiable consumer requests within forty-five (45) days of receipt. If we require more time (up to an additional forty-five (45) days), we will inform you of the reason and extension period in writing.

California Do Not Track Disclosure

In accordance with California law, we recognize and honor Global Privacy Control (“GPC”) and other legally recognized opt-out preference signals. When we detect a GPC or similar opt-out preference signal from your browser, we will treat it as a valid request to opt out of the “sale” or “sharing” of your personal information for that browser or device, and we will process this request without requiring you to take any additional steps. If you have previously enabled a consumer-specific privacy setting that conflicts with a subsequently detected opt-out signal, we may contact you to confirm your preference. To learn more about IBA or to opt-out of this type of advertising, visit the Network Advertising Initiative website and the Digital Advertising Alliance website. Options you select are browser- and device-specific.

Children’s and Minors’ Privacy

Our Site and services are not directed to children under the age of thirteen (13), and we do not knowingly collect personal information from children under thirteen. If we learn that we have collected personal information from a child under thirteen without verification of parental consent, we will delete that information as quickly as possible. If you are a parent or guardian and believe your child under thirteen has provided us with personal information without your consent, please contact us at privacy@hasa.com. Parents have the right to review personal information collected from their child, direct us to delete it, and refuse to permit further collection or use.

For California residents, we do not have actual knowledge that we sell or share the personal information of consumers under sixteen (16) years of age. If we have actual knowledge that a consumer is under sixteen, we will not sell or share their personal information without affirmative authorization (“opt-in”) from the consumer (if age 13-15) or from the consumer’s parent or guardian (if under age 13). If a minor (or the minor’s parent or guardian) has opted out, we will wait at least twelve (12) months before requesting authorization again.

Notice of Financial Incentive

We may offer programs, including our App loyalty program and SMS/MMS Mobile Message Marketing Program, that provide certain benefits (such as discounts, exclusive offers, or rewards points) in exchange for your participation. These programs may constitute a “financial incentive” under California law because they involve a price or service difference related to the collection of personal information. Your participation may involve the collection of personal information such as your name, email address, phone number, purchase history, and preferences.

Material Terms. Participation in these programs is voluntary. You may join by creating an account in the App, signing up for our mailing list, or opting into our SMS/MMS program. You may withdraw at any time by deleting your account, unsubscribing from marketing communications, or following the opt-out instructions provided. We will not penalize you for withdrawing, though you will no longer receive the program’s benefits.

Value of Personal Information. The value of the personal information we collect through these programs is reasonably related to the value of the benefits provided to you. We estimate the value of personal information collected by calculating the per-consumer cost of operating the incentive program (including discounts, rewards, and administrative expenses) and comparing it against the per-consumer revenue and operational improvements attributable to the data collected. This estimate is updated annually to reflect changes in program participation and costs.

Personal Information Shared for Behavioral Advertising. Personal information disclosed to third-party advertising partners for cross-context behavioral advertising is subject to those partners’ retention policies. We do not control how long third parties retain information received from us.

California Shine the Light. California Code permits California residents to request information regarding the disclosure of their personal information to third parties for direct marketing purposes. HASA does not disclose your personal information to third parties for their direct marketing purposes. If you have questions, please contact us at privacy@hasa.com.

Access And Update Your Information

In addition to the rights described above for California residents, all users can access or update their personal information in the following ways:

    • Review and update your account information, including contact, billing, and shipping information, by logging into your HASA account
    • Email: privacy@hasa.com with your current contact information and the personal information you would like to access. We will provide you with personal information requested if reasonably available, or will describe the types of personal information we typically collect.

Security Of Your Information

We maintain physical, electronic, contractual, and administrative safeguards designed to protect your personal information. When we or our service partners collect or transmit sensitive information such as a credit or debit card number, industry standard methods, such as data encryption, role-based access control, third-party security measures and incident response procedures, to protect that information. However, you are also responsible for taking reasonable steps to protect your personal information against unauthorized disclosure or misuse.

Storage And Transfer of Information

This Site is operated by HASA from our offices in Saugus, California, USA, for users in the United States. Information will be stored in the United States. Those who choose to access this Site from other countries or territories do so at their own risk.
